1. General Provisions
These Terms and Conditions ("Terms") govern the use of the Smart Zugdidi digital platform ("Platform"), operated by Zugdidi Municipality Waste Management Service ("Service Provider").
By using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.
Definitions:
- Platform — smartzugdidi.ge website and related digital services
- User/Subscriber — any individual or legal entity using the Platform
- SZ Code — unique subscriber identification code (format: SZ-XXXXXX)
- Services — waste collection and related services provided through the Platform
2. Services
The Platform provides the following services:
- Regular household waste collection
- Construction waste removal (by arrangement)
- Commercial and restaurant waste services
- One-time waste pickup
- Online payment processing
- Order tracking and management
Service availability depends on your location within Zugdidi Municipality. The Service Provider reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Registration and Account
To fully use the Platform, you may register an account. Registration requires:
- Valid SZ subscriber code
- Valid email address or phone number
- Accurate personal information
You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility.
The Service Provider may suspend or terminate accounts that violate these Terms or are used fraudulently.
4. Payment Terms
4.1 Pricing
Service fees are published on the Platform and may change with 30 days' notice. Current pricing:
- Household waste collection: from 10 GEL/month
- Commercial services: individual agreement
- One-time pickup: from 15 GEL
4.2 Payment Methods
We accept: bank cards (Visa, MasterCard), BOG Pay, TBC Pay, QR payments, and cash at designated locations.
4.3 Late Payment
- Payment is due by the end of each billing period
- Overdue accounts receive SMS reminders
- After 30 days, a daily penalty of 0.1% may apply
- After 60 days, service may be suspended
4.4 Refunds
Refunds are processed within 10 business days for overpayments or canceled services (before execution).
5. User Obligations
By using the Platform, you agree to:
- Provide accurate and current information
- Pay for services on time
- Properly sort and prepare waste for collection
- Not dispose of prohibited materials (medical waste, hazardous chemicals, etc.)
- Ensure access for collection vehicles
- Not misuse or attempt to hack the Platform
- Not use the Platform for illegal purposes
6. Limitation of Liability
The Service Provider is liable for:
- Performing agreed services with reasonable care
- Maintaining Platform security and availability
- Processing payments securely
The Service Provider is NOT liable for:
- Service interruptions due to force majeure (weather, natural disasters, etc.)
- Damage caused by improper waste disposal by users
- Technical issues beyond our control
- Indirect or consequential damages
Maximum liability is limited to fees paid in the last 12 months.
7. Termination
User-initiated: You may terminate services with 30 days' written notice. Outstanding balances must be paid.
Provider-initiated: We may terminate services for:
- Non-payment exceeding 90 days
- Violation of these Terms
- Fraudulent activity
- Property relocation outside service area
Upon termination, your account data is retained for 1 year for legal purposes.
8. Dispute Resolution
Disputes should first be addressed through our customer service (info@smartzugdidi.ge).
If unresolved within 30 days, disputes shall be governed by Georgian law and submitted to the courts of Zugdidi.
Consumer protection rights under Georgian law are preserved.
9. Changes to Terms
We may update these Terms periodically. Changes will be:
- Posted on the Platform with 14 days' notice
- Communicated via email to registered users
Continued use after changes constitutes acceptance of new Terms.
